The Do’s & Don’ts of Hiring & Firing
At every stage of the hiring process, employers must be careful not to illegally discriminate against applicants for the position. Since discrimination is prohibited on the basis of race, gender, national origin, age, religion, and disability – and by now most job applicants know that – any indication of bias in the hiring process might lead to serious legal repercussions.
For example, even a seemingly innocuous question during the interviewing stage such as “when did you graduate from high school?” can potentially lead to a lawsuit under the Age Discrimination in Employment Act (ADEA)
In this on-demand webinar where we’ll discuss:
- Discrimination; based on race, gender, national origin, religion and disability
- Having proper paperwork done before firing an employee; performance evaluations, disciplinary action forms, attendance sheets
- The Employment Retirement Income Security Act (ERISA) (prohibits discrimination in employee retirement plans)
- Fair Labor Standards Act (FLSA) (federal law regarding wage and hour issues)
- Family and Medical Leave Act (FMLA) (federal law providing job-protected family and medical leave)
- Sarbanes-Oxley Act (protects workers who are whistleblowers)
